Terms of Use

1. About these terms

By creating an account or using member features, you agree to these Terms of Use, our Privacy Notice, Community Guidelines and applicable safety rules.

If you do not agree, do not create an account or continue using the service.

2. Adults only

You must be at least 18 years old to create or use a Zwag member account. You must not create an account for a child, permit a child to use your account, or knowingly use Zwag to seek sexual or romantic interaction with anyone under 18.

Zwag may restrict or remove an account where there is a reasonable concern about age eligibility or child safety. Where we have reasonable grounds to believe that a member may be under 18, we may withhold or suspend access and require satisfactory documentary evidence of age before allowing the account to use the service.

3. Your account

• Provide accurate account and profile information.
• Use your own identity and photos you are entitled to use.
• Keep your login credentials confidential.
• Do not create accounts to evade a restriction or ban.
• Tell us promptly if you believe your account has been compromised.

4. Acceptable use

You must not use Zwag to:

• commit, encourage, facilitate or advertise illegal activity;
• threaten, harass, stalk, intimidate, exploit or deliberately deceive another person;
• impersonate another person or operate a fake, misleading or scam profile;
• solicit money, gift cards, cryptocurrency, investments or financial credentials through romance fraud or other deception;
• upload or share child sexual exploitation or abuse material, sexual content involving minors, or content that sexualises minors;
• share non-consensual intimate images, threats to share intimate images, or sexual material involving coercion or exploitation;
• upload, publish or send pornographic content or other explicit sexual material through profiles, photos or messages;
• encourage, promote or provide instructions for suicide, self-harm or eating disorders;
• promote terrorism, credible violence, trafficking or other serious criminal conduct;
• send spam, malicious code, automated scraping, credential-harvesting links or other abusive technical content;
• publish another person's private information without a lawful and appropriate basis.

5. Profiles, photos and messages

You remain responsible for content you upload or send. You must have the necessary rights to use that content and must not infringe another person's copyright, privacy or other rights.

You give Zwag a limited, non-exclusive licence to host, reproduce, resize, display and otherwise technically process your content only as reasonably necessary to operate, secure, moderate and provide the service.

6. Moderation and account action

Zwag may review profiles, photos, reports and other content for compliance with these terms, the Community Guidelines and applicable law. We may reject content, issue warnings, require corrections, restrict features, suspend or block accounts where reasonably necessary.

Where applicable law requires a particular complaints, reporting or enforcement process, Zwag will apply that process in addition to these contractual rights.

7. Illegal content, reporting and complaints

Users can report concerns using Zwag's in-service reporting features and the routes described on our Online Safety, Reporting & Complaints page.

When Zwag becomes aware of content that it reasonably determines to be illegal, it may remove or restrict that content and take proportionate action against the relevant account. Serious matters may be referred to appropriate authorities where required or permitted by law.

8. No guarantee of a match or another member's conduct

Zwag provides tools for members to discover and communicate with each other. We do not guarantee that you will receive matches, messages or form a relationship, and we cannot guarantee the identity, intentions or conduct of another member.

9. Payments and voluntary support

If Zwag offers voluntary donations or paid functionality, the price, payment provider and any specific payment terms will be shown before a payment is made. A donation does not guarantee matches, moderation outcomes or preferential treatment.

Any future paid subscription or digital service must be accompanied by the consumer information, cancellation and refund terms required for that product before it is offered.

10. Availability and changes

We may maintain, change or temporarily suspend parts of Zwag for security, technical, legal or operational reasons. We will not use this clause to remove statutory consumer rights.

11. Liability

Nothing in these terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or your statutory consumer rights.

Subject to those protections, Zwag is not responsible for losses that were not reasonably foreseeable when you agreed to these terms or for losses arising solely from another member's independent conduct where Zwag has complied with its applicable legal duties.

12. Ending your use

You may stop using Zwag at any time. Account deletion and data retention are subject to the Privacy Notice and any information that must reasonably be retained for security, legal claims, regulatory or statutory purposes.

13. Governing law

These terms are governed by the law of England and Wales, without depriving consumers resident elsewhere in the United Kingdom of any mandatory protections or court rights that apply to them.
